Article 1 – Purpose
These Terms and Conditions govern the sale of eSIM plans offered by SimyGo SAS, a French simplified joint-stock company registered with the Trade and Companies Register, hereinafter referred to as "SimyGo", through its website simygo.app and mobile application.
Article 2 – Products and services
SimyGo sells international mobile data plans in the form of eSIM (electronic SIM). Plans include a data volume, a validity period, and a coverage area specified at the time of purchase. SimyGo does not provide a phone number or voice/SMS service.
Article 3 – Order and payment
The customer places an order via the SimyGo website or app. Payment is made online by credit card or any other payment method offered. The order is confirmed after payment acceptance. The customer receives a confirmation email with eSIM installation instructions.
Article 4 – Delivery
The eSIM is delivered instantly electronically (QR code or direct activation in the app). No physical shipment is made. The customer is responsible for verifying the compatibility of their device with eSIM technology before purchase.
Article 5 – Pricing
Prices are displayed in euros (EUR) or the currency selected by the customer, including all applicable taxes. SimyGo reserves the right to modify its prices at any time; plans are billed at the price in effect at the time of order.
Article 6 – Right of withdrawal
In accordance with Article L.221-28 of the French Consumer Code, the right of withdrawal does not apply to digital content provided on a non-tangible medium whose execution has begun with the consumer's agreement. As the eSIM is digital content activated immediately, the customer expressly waives their right of withdrawal.
Article 7 – Liability
SimyGo is committed to providing quality service but cannot be held liable for network interruptions due to local operators, device compatibility issues, or any non-compliant use of the service. SimyGo's liability is limited to the amount of the purchased plan.
Article 8 – Applicable law
These Terms and Conditions are governed by French law. Any dispute relating to their interpretation or execution falls under the jurisdiction of French courts. In case of dispute, the customer may resort to conventional mediation or any other alternative dispute resolution method.
